Prologue

The purpose of these Terms is to define the conditions under which Users may access and use the Services koxydesign.com. All available contact details can be found here.

Any User who accesses the Services offered by koxydesign undertakes to comply, without reservation, with the terms of use (TOU) also referred herein as terms of service (TOS) or terms and conditions (T&C) supplemented, by the privacy and cookie policy.

If the User does not agree with all or part of the terms, it is strongly recommended that he/she does not use the Site and the Services.

Koxydesign is free to modify, at any time, these TOS, to consider any legal, regulatory, jurisprudential and/or technical developments. The version that prevails is the one that is accessible online at the following address: koxydesign.com. All Users are therefore required to refer to their version accessible online at the date of their access and use of the Services.

CAPACITY

Use of the Services is restricted to users who are natural persons capable of subscribing in accordance with the laws of the country or by whom it has been mandated for this purpose.

The User may use the Services on behalf of third parties over whom he/she has parental authority or for which he/she is recognized as tutor or curator in accordance with the law.

Information, Responsibilities and Guarantees towards the Services

Koxydesign sets up the necessary measures or means for the smooth running and quality of the Services. The User acknowledges that his/her use of the Services is at his or her own risk. The Services are provided to him or her “as is” and are accessible without any guarantee of availability and regularity.

Koxydesign cannot under any circumstances be held liable for any indirect damage suffered by the User when using the Services. Indirect damages are those that do not result exclusively and directly from the failure of the koxydesign’s Services. In addition, koxydesign cannot be responsible for acts performed by the User or a third party using the Services.

Any content (text, images voice notes or software) downloaded by the User or obtained in any other way when using the Service, is at the User’s own risk.

The User account includes its Identifiers and placed under the exclusive responsibility of the User. The User undertakes to keep them secret and not to disclose them in any form whatsoever. If any of the User’s identification elements are lost or stolen, the latter must immediately inform Koxydesign, who will then proceed to the cancellation and/or immediate update (s) of the Identifier concerned.

The User is solely responsible for the use made of his/her Identifiers, even if the User pre-registers on his/her computer, mobile phone or any other type of equipment his/her ID, thus allowing the automatic connection to Services.

Any access, use of the Services and transmission of data made from the account of a User will be deemed to have been made by the latter. The safeguarding of the confidentiality of the User’s Identifiers is the sole responsibility of the User. In this regard, the User is required to ensure that at the end of each session he effectively disconnects the Services, especially when he/she accesses the Services from a public computer.

Any loss, misappropriation or unauthorized use of a User’s Identifiers and their consequences is the sole responsibility of this User. In all the cases mentioned above, the User must inform koxydesign, without delay, so that koxydesign can reset the User account.

The services

• All services on the site are provided at a fee except otherwise stated.
• Except otherwise stated, all services under website development and graphic design will require a 50% deposit including any other information stated in the respective product description before work can commence.
• Services involving social media or SEO will require complete payment before work can start.
• No refund is possible once work has started. Otherwise, it will be at the discretion of koxydesign.
• If a customer misunderstood the features or services offered under a given package, then he or she will be refunded in full if an agreement with koxydesign cannot be met. No refund on work that has already started. Otherwise, it will be at koxydesign’s own discretion.
  It is the users own responsibility to carefully read the features offered under any package before effecting payments. If user requires further explanation, then he/she can email us for clarification.
• All services come with a custom package, so users can always request for one if the stated packages do not suit their need
• Except otherwise stated, all web developments are built using WordPress as a content management system (CMS).

The blog

A blog page was created to help our users on all levels to better understand our services or products and how to use them if applicable. The use of information on the blog is not exclusive to our customers alone but to anyone who visits the site. Anyone is welcome to use any tricks shared on this site in their free or commercial projects. You are also welcome to reference our snippets and hacks on your own blogs/sites as long as you give us full credit from that article.
